US investigates UK's push for Apple backdoor amid data treaty concerns

What just happened? The United States' relationship with the UK could come under further strain following news that US officials are investigating whether its ally broke a data treaty by demanding that Apple build a backdoor into iCloud.

Last week, Apple removed its Advanced Data Protection feature for UK users. The extra layer of security encrypted synced iCloud content such as photos, notes, reminders, bookmarks, and iCloud backups so that only users could access it on trusted devices. Even Apple cannot decrypt customer accounts to access their data.

The move came after Apple spent months denying the UK government's requests for the company to create a backdoor allowing agencies to snoop on users' encrypted data. The UK Home Office issued the technical capability notice under the Investigatory Powers Act of 2016, commonly referred to as the "Snoopers' Charter."

Rather than complying, which would have had global implications regarding its security standards, Apple simply removed the Advanced Data Protection option for new UK users – existing ADP users will have to disable the feature manually during a grace period.

Now, Reuters reports that in a letter to two US lawmakers, Tulsi Gabbard, the US director of national intelligence, said the US is examining whether the UK government had violated the Cloud Act.

The Act states that the UK may not issue demands for data of US citizens, nationals, or lawful permanent residents, nor may it demand data from persons located inside the United States.

In the letter, addressed to Oregon Democrat Ron Wyden, and Arizona Republican Rep. Andy Biggs, Gabbard wrote, "My lawyers are working to provide a legal opinion on the implications of the reported U.K. demands against Apple on the bilateral Cloud Act agreement."

Apple has long fought against demands from law enforcement and governments if it feels that they threaten the security of Apple products.

In 2023, Apple threatened to withdraw FaceTime and iMessage from the UK in response to a proposed change that would require it and other messaging services to clear new security features, including iOS updates, with the UK government before they are rolled out.

The most famous instance came in 2016, when a judge ordered Apple to help the FBI access the locked iPhone that was owned by Syed Rizwan Farook, one of the San Bernardino shooters. Tim Cook refused, stating that building a version of iOS that bypasses several important security features to access the handset would undeniably create a backdoor.

"If the government can use the All Writs Act to make it easier to unlock your iPhone, it would have the power to reach into anyone's device to capture their data," Cook wrote at the time. "The government could extend this breach of privacy and demand that Apple build surveillance software to intercept your messages, access your health records or financial data, track your location, or even access your phone's microphone or camera without your knowledge."

That's fine by me, the people of the UK seem to have it coming to them at this point, way too much corruption, bad policies and in-action within the government now for 20+ years, getting worse and worse, year-by-year, and still no real civil unrest.
If we were french, we'd have been protesting continously for at least 10 years now.

Sounds like you would also like government cameras in private homes and businesses. If you're not in favor of that, then you must be keeping all sorts of horrible crimes covered up and are trying to hide yourself from the nasty justice department meddling in your degenerate life. Oh wait that's totalitarianism??

And if you try to claim it's private property, so is your phone. Apple's servers aren't, but neither are the banks that lend you money to buy your home. They could be required to have cameras installed on all mortgagees' properties following the same exact logic as you. It's not like you have to use their services! Remember this is for your own safety ;)

Personally, I think that anyone who isn’t assuming that all of their content is accessible is living in a fantasy. Apple has this schtick of ‘protecting everyone’s data come hell or high water’. But to me, it’s a coin toss as to whether that’s actually happening or in 12 months Tim Cook is getting deposed and saying, “I said that we were protecting it. I didn’t say it was actually safe.”

Recall the onslaught of media vomit about how China was hacking all of our institutions, corporations, etc; How we were defenseless against them. And then the Snowden drop happened and it was like, “Oh we’re actually 10x worse… Massive Utah data center… Five Eyes… Hey, look. We can turn on the German Chancellor’s phone and listen whenever we want.” So if the German government can’t even keep their highest elected official safe from CIA snooping, does anyone really think FB would be much better?

Mark has his committee meeting that happens in front of the cameras with the senators and C-SPAN reporting live. And then he has his meeting behind closed doors. And those two things are not the same.

There used to be a time when your political beliefs didn't define you... also, there were times when people didn't have to agree with every aspect of their party...

I'm a Canadian - I tend to vote Conservative provincially, and Liberal federally... I prefer the "lower taxes" of the Conservatives but the Infrastructure/Social Services of the Liberals...

If I was American, I'd probably be torn, as I prefer the Republican economic strategies but lean towards the Democrats' social policies..

And that would likely make you a moderate. Someone who seeks to find the happy middle-ground and look for solutions to problems that fit the problem instead of fitting within a brainless agenda.

That very neatly brings us back around to the subject of this article. The UK, instead of doing what is proper, correct and appropriate, seek to use short-cuts that violate the rights of the citizen as opposed to doing proper investigative work to find criminals and evidence of their wrong-doing. They are effectively treating everyone like criminals instead of doing what is correct an assuming innocence until proof of guilt is found.

More on one side than the other. Progressivism (not liberalism) is based on many things of which one is Marcusian “Repressive Tolerance”. If I could put a tagline on its basic view, it would be Hilary’s ‘basket of deplorables’ comment (probably the first time she’s ever been honest)… The Republican’s don’t have a Klan or skinhead problem. We’ve put them in the basement where they belong. Alternatively, the Democrats have completely let their party be taken over by the progressives. They’ve let the universities be taken over by the progressives. And their media is an offshoot of both. Is it any wonder that lifelong Democrat, Donal Trump, is now a Republican? Or Tusli Gabbard? Joe Rogan? Elon Musk? Or RFK (a freaking Democrat blue blood!). The only ones left are the ones who insist that men can become women and the corporatists who saw Kamala get 2:1 donations over Trump by the ‘billionaire class’ while still laughably donning the veneer of ‘fighting the power’.

And the country responded appropriately. Anyway, this has veered way off track. And for my part, I apologize. Hope everyone has a good day. And fwiw, I would not assume that anything on FB, Apple or any other platform, ‘secured’ or otherwise, is safe from prying eyes.

Correct. They want effortless, mass surveillance. It is authoritarian oppression by the state. If it was about ‘stopping the pedos or terrorists’, they’d go to the courts and get warrants for THOSE SPECIFIC PEOPLE WHO THEY COULD IDENTIFY. Instead it’ll be a fishing expedition, highly-likely abused, with the larger ‘effect’ of the citizenry being terrified to say anything to anyone about anything. And if that’s how you want to run your society, well, maybe that works for some people. Seems pretty dark to me though.
